Our Terms & Privacy
Last Modified: September 4, 2024
This end user license agreement, known as the "Terms",
represents an agreement between you, the customer, and Beyond Ordinary Software Solutions, the "Company" that
is hosting and managing this web application known as AskUncleSam.AI or AskUncleSam.AI, the "site". The site, physical and virtual machines,
the network, the security appliances, the operating systems, network storage, and database storage, are collectively known as the "system".
By using this site, and creating a login for the site, you are agreeing to these Terms, and
any modifications that will occur in the future. If you do not agree to these "Terms" then you should stop using this
site immediately.
Fair Use Doctrine
Entering any information for use by our system is a willful grant of license to us by you. We will use that information to create a
ranking that describes how compatible your narrative is with the requirements of a solicitation.
By using this system and submitting data to this system you are indemnifying us from any harm that may arise from the use
of the narrative. If you are not authorized to use this system then you must stop using it immediately. Continuing to use this system
is an at-will act that implies that you have the right to know and distribute the narrative. Furthermore, you are granting us a
royalty free and perpetual license to use, store, and make use of, any information you enter into our systems.
Sale of Data
We are not data brokers and we do not employ the use of data brokerage in our trade. All of your data, the narratives
and your matches, are encrypted and kept confidential. None of your data is shared with a third party data broker. We do not sell data to
third parties.
You ever wonder if those other guys are sharing your searches and interests with your competitors? We don't do that today, and
do not intend to do that in the future. Your intimates are sacred with us and we do not kiss and tell.
Scope of License
This license is not transferrable. You are not authorized to share your login and account access with anyone other
than yourself and your colleagues at your place of business. If you disregard this rule and factor your account with other users outside
of your business, then we will terminate the account without warning and you will lose any data or entitlements that you may have purchased.
If your business is the business of helping others get public entity contracts, then your business is not authorized to use this
service. Your use of the service is the same as factoring results for third party distribution, which is not allowed by policy. You are not allowed
to resell or redistribute the results of this service to any third party.
This application is only for use by individuals and their companies who are authorized to search and bid on contracts
found on SAM.GOV and other public entity web sites. This typically means you must be a US citizen or a US-based company with a
physical address in the United States of America.
Compliance with Law
We will cooperate with United States law enforcement at any level when requested to provide records of access, payment, search
histories, narratives, and any information that we steward which can be compelled by legal instrument.
Processing of your data
Your data, in its digital form, is being processed by many parties. First, your desktop machine's operating system is processing your
keystrokes and sending that data through a firewall appliance and several network routers to get to our data center. That data center's network operations
staff manage how that data gets to our sytems. Our systems use web servers, database servers, TLS termination, and OpenAI GPT-4 to process your data into
the result that you are expecting from us.
We can only control what happens to your data when it reaches our systems. In our systems, your data is stored in a database using encryption. We do
not share your information directly with any vendors except to send OpenAI your narrative for the AI matching. Payments are processed through PayPal using an API
service call to their known domains for such action.
Types of data we send to the AI service: Narrative
Types of data we send to SAM.GOV: search keywords, dates, naics codes, etc. Things you enter into the search input.
Protecting your data
Your data is encrypted using state of the art encryption algorithms that are widely accepted as secure for this application. Your internet
experience to our system is being protected using TLS encryption. This means the transport encryption between you and our systems is TLS (1.3) and
the at-rest protection is private key cryptography with encapsulation and base64 encoding. For instance our own API key, stored in our database, looks
like this: 5gLUONbney2QIgyPWOsrYpiqbIsm6KVKrXxWz6mNnewuapbeGxBU+sFWpsqKfc32-MnDdG1WF/nR6Vt3QwFKo/Q==. Good luck decrypting it. If you can break it
there is a job for you open at NSA.GOV, apply now.
Administrators are able to see your data using our administrator application which is capable of decrypting the data you provide to us. Access
to this data is closely monitored and controlled by permissions. Types of data that administrators can see: username, real name, email address, contact
information. Types of data administrators can change: password, apikey, email address, contact information.
California Consumer Protection Act
Any person from Planet Earth who has an account in our system may request that account be removed/scrubbed from our
systems. We will comply with this request and delete the account from our systems. We will make note of this request so that future
data recoveries do not inadvertently restore the data that was removed.
The CCPA does not cover businesses. Your business information will be retained if you are on a team account. If you
are the only login for your account then all of your information, including any narratives and queries and the associated storage
that you may have purchased, will be removed from our systems.
When complete we will send you an email confirmation regarding the removal of the data in your request. Some records must be
maintained by law, such as payment records and access records. We will continue to maintain these records for as long as we are legally
obligated to keep them. Some of the logs will contain the username that you used during signup.
Jurisdiction
The legal jurisdiction for this license and the data stored by this application is The United States of America, state of California,
county of San Diego, and city of San Diego. Any legal disputes will be resolved in the courts of San Diego, California.
Use of this site is your acknowledgement and acceptance of the jurisdiction and all terms in this license.
No Warranty
This site uses AI to perform the services that you pay for. There is no guarantee that it will perform at the level
you expect. We do not warrany its ranking system and do not suggest that you use the results herein as your only guidance when
deciding to bid on an opportunity. This site is just one step in the complex process of making a successful bid on a solicitation.
Cookies
This site uses cookies, which are files stored by your web browser. These files contain privatized information
that our system uses to make your login easier. If you are using a computer that is shared with other people then you should
always logout from the system.
There are 2 cookies written by this site. One is for the ASP.NET session state used to keep you logged in and to manage your
connection into our system. The other is one that we write for the site which contains your user ID and your user login name,
both encrypted. If you do not opt to be "remembered" during login then the login name will not be saved and only your login ID
will be saved in the site cookie.
The web browser you are using right now is the software that sends us the cookies that we instruct it to write to your machine on our
behalf. If you disable cookies then you will not be able to use the site.
We do not use third party monitoring tools like Google Analytics, Facebook Pixel, or any other embedded spy service.
We do not use third party cookies in any form except for the ASP.NET session cookie that is dropped from Microsoft IIS.
Session storage, local storage, shared storage, are all kinds of virtual data stores managed by the browser. We are not using
any of these storage mechanisms. Paypal uses "Local Storage" to store payment context information when you purchase consumables
from us. You can see all of this by opening the "Developer Tools" of your browser (Web Developer Tools in Firefox) and looking at the
Application tab. There you will see a "Storage" tree with obvious nodes that should make sense to you.
